Abstract

Simeon Souther was an enslaver from Virginia who was indicted in October 1850 for murdering his slave. Souther’s indictment contained fifteen counts due to the various modes of punishment and torture he used, which resulted in the homicide of an enslaved man named Sam. Under Souther v. Commonwealth, “wilful and excessive whipping” of an enslaved person “is murder in the first degree.”
