Abstract

One of the major tasks mandated to the U.S. Congress under the newly ratified Constitution was to create something which did not then exist—an organized federal courts system. Article III, Section 1 of the Constitution set out the general, and very sketchy, template: that there would be a Supreme Court and “such inferior courts as Congress may from time to time ordain and establish.” The office of Chief Justice is, however, mentioned in Article I, Section 3, Clause 6.
